Mumbai HC Rejects Bail Plea Of Woman Who Posted Explicit Photos Of Ex-Boyfriend

The woman reportedly tagged the school of her former lover's daughter in the explicit images that she shared online.

The Mumbai High Court rejected the pre-arrest bail application of a woman who allegedly posted explicit photos of her ex-boyfriend on social media and tagged his daughter’s school page. The court was informed by her counsel that the woman was misconceived and falsely implicated in the case.

The single-judge bench of Justice Bharati Dangre was hearing the anticipatory bail application of the woman. She had been in a consensual relationship with the married man since 2010. He decided to break off the relationship after 10 years, in 2020.

The woman allegedly created a fake Instagram account and posted pictures of the man kissing her and tagged his daughter’s school. She also emailed his nude pictures, featuring him in a compromising position to his wife.

Reportedly, the woman insisted that the man divorce his wife and marry her, leading to frequent quarrels. The survivor also alleged that the woman began blackmailing him with compromising pictures and later posted the picture of him kissing on social media.

He eventually filed a complaint against the accused in May and she was booked under various sections of the Indian Penal Code and the Information Technology Act.

On August 3, the woman’s first pre-arrest bail application was rejected by the lower court. The court said, “The applicant (woman) and the informant (man) can spend their whole life fighting and litigating with each other for their own wrongs, but the applicant has no right to disturb the peace and tranquillity of the informant’s daughter and family.

The court added that the woman’s actions had far-reaching consequences on the image, career, welfare, and future of the girl. It further said that based on the woman’s conduct, there was a possibility that she would take further steps to damage the future of the man’s daughter.

Advocate Shehzad Naqvi, who filed the complaint on the man’s behalf, opposed the bail application and stated that his client’s life was ruined and his daughter faced humiliation in school. The court based its order on the submission of the investigation officer that the woman did not cooperate with the investigation and that her computer and mobile had not been recovered yet.
