In a shocking incident, a woman bites her husband's genitals after being fed up with his demands for unnatural sex. The incident happened in the Hamirpur district of Uttar Pradesh on the night of January 28.
As per reports, on the night of January 28, the couple had a dispute over unnatural sex. It made the wife so upset that she bit her husband's genitals with her teeth. The 34-year-old husband, Ramu Nishad, was badly hurt and was bleeding. He was immediately sent to a nearby hospital where the doctors shifted him to a better hospital with more facilities as his situation worsened.
The wife has been accused of criminal intimidation
The wife has been charged under Section 326 of the Indian Penal Code (IPC) for voluntarily causing grievous hurt and Section 506 for criminal intimidation.
An investigation has been launched in the case and the action will soon be taken against the wife.
In our country, marital rape is still not a crime so even if the husband is guilty of demanding non-consensual unnatural sex from his wife, he cannot be punished. A ruling of the Madhya Pradesh High Court last year said that husbands cannot be charged for non-consensual unnatural sexual relations with their wives. The court had said that the Section 375 of IPC excludes husbands as marital rape is not a crime. It further said that anything between a husband and a wife that is beyond "natural sexual intercourse" cannot be simply labelled as "unnatural" because marriage is not just for procreation.
Delhi High Court last year had further said, "Willful denial of sex by a spouse amounts to cruelty." The court had stated, "various acts that may amount to mental cruelty, and one such illustration was the unilateral decision of refusing to have intercourse for a considerable amount of time without there being any physical incapacity or valid reason."
Violence is not the answer
Even though the husband is on the hospital bed fighting for his health, we cannot ignore the patriarchal partiality that this case reminds us of. Of course, the wife is wrong for committing domestic violence and leading her husband to hospital. But the husband too is accountable for crushing the woman's right to consent in sexual relationships.
Let us look at the case in this way. The woman should have just said no and walked out of the toxic relationship. And the husband too should have respected his wife's choice and not forced her for anything. Violence is never the answer to any problem. So it is high time that we call out sensitive issues like marital rape and save people caught up in them before it gets too late.
