The man feared that after the departure of the US from Afghanistan, ISIS fighters could be hanged. VJ Sebastian Francis filed a petition which said that necessary action should be taken by the officials concerned to extradite his daughter Sonia Sebastian Ayisha and his seven-year-old granddaughter.

His plea also claimed that the issue is very important to attend to on an immediate basis as many politically and administratively significant changes were taking place in Afghanistan post the departure of the US troops.

The plea also mentioned that the centre was not assisting the extradition which was unconstitutional and illegal. The father claimed that the centre's stand violated fundamental rights guaranteed under Articles 14,19 and 21 of the Constitution.

After Ayisha left India to join a terrorist group, a case under the stringent anti-terror law Unlawful Activities (Prevention)Act was registered against her. In addition, Interpol issued a Red Corner Notice against her in March 2017.

The plea also briefed that after Ayesha's arrival in Afghanistan,  her husband was allegedly killed in the war. After that the woman and child had to surrender to the forces of the country in 2019.

The petition also claimed that his daughter battled the decision to join ISIS and was willing to return to India and witness a fair trial. Ayisha reportedly admitted this during an interview with Stratnews Global. It was displayed as a documentary titled Khorasan Files as it captured the journey of Indian Islamic State Widows.
