The Tis Hazari court of Delhi has framed charges of rape under sections of POCSO against expelled BJP MLA Kuldip Sengar accused of raping a minor girl twice in 2017. District Judge Dharmesh Sharma has also charged Sengar’s aid Shashi Singh for kidnapping the girl. Sengar and Singh have been framed under sections 120b, 363, 366, 109, 376 (i) and 3 and 4 of Protection of Children from Sexual Offences (POCSO) of the Indian Penal Code. They are currently lodged in Tihar Jail.

CBI told the court on Thursday that the survivor’s father was falsely implicated in the Arms Act case registered by the UP Police. It said that on the day her father was being taken to the police station, Then Bangarmau MLA Sengar had made multiple calls to two policemen and the survivor.
“The victim’s father was badly beaten. During our investigation, we found that the victim’s father was falsely implicated in a criminal conspiracy. The father was allegedly found with one country made pistol and four live cartridges and we have multiple witnesses who stated that at that point the deceased was not carrying a pistol,” CBI counsel Ashok Bhartendu told the court, Indian Express reported.
The CBI has booked 10 persons including Sengar, who is already in jail, for murder and the apex court has asked the CBI to complete investigation into all five cases within 45 days.

Sengar and his associates were booked in a case of criminal conspiracy, murder and attempt to murder on July 30 after the rape survivor along with two of her aunts and lawyer Mahendra Singh met with an accident on their way to meet with her uncle in Rae Bareli. Both her aunts succumbed to death in the accident while she and her lawyer got severely injured and are hospitalised in Delhi.
The Supreme Court transferred the case to Delhi Court which is holding daily hearings in the case after the accident. A total of five cases are filed against Sengar and his accomplices in the Unnao rape and accident cases.

A year after the case came to light Sengar was charged with the rape case and it became a matter of national concern, BJP finally expelled Sengar a week ago. It was after a lot of pressure from the public across the country and concerns raised by several influential people that the party took the decision. “The BJP has expelled MLA Kuldeep Singh Sengar from the party,” said Chandra Mohan, state spokesperson of the BJP, in the evening of August 1. Uttar Pradesh BJP chief Swatantra Dev Singh confirmed to news agency ANI that the “central leadership” of the party had expelled the rape accused lawmaker.
Last year, the girl’s father was allegedly beaten up ruthlessly by Sengar’s brother Atul Singh and others in the village. He died a few days later in police custody. The UP police transferred the case to CBI in April when Sengar was also apprehended by the police.
