The suit was filed by Babuji Shah who is none other than Gangubai Kathiawadi's purported adopted son. He mentioned that the novel presents defamatory information against Kathiawadi. He further added that it has tarnished her reputation and damaged their rights to privacy.
Advocate Narendra Dubey said that the authors did not seek any rights or permission from the family before publishing the novel. He also claimed that the authors did not obtain the information published through authentic sources like the family itself.
Director Sanjay Leela Bhansali on behalf of the Bhansali Productions and Bollywood actress Alia Bhatt filed a notice of motion as a defendant in the suit. He sought the rejection of the suit under Order VII Rule 11 of the Code of Civil Procedure (CPC) under the following points:
- The suit is barred by limitation since the novel was published in the year 2011 and the suit was filed only in December 2020;
- Babuji Shah has not submitted any proof that he is indeed the adopted son of Gangubai Kathiawadi.
- He has also not joined the other recognised family members who claimed the contents to be false.
Additional Sessions Judge RM Sadrani allowed the notice of motion by Director Sanjay Leela Bhansali. And further, the plaint filed by Babuji Shah was rejected.
