IIT Guwahati Rape Case Bail: An IIT-Guwahati student raped a fellow mate on March 28, 2021. On April 3, the police had arrested a 21-year-old student for the same. He has now been granted bail. As per the Guahati High Court, the accused is a talented student and will prove to be the state’s future asset.
The bench of Justice Ajit Borthakur heard the counsel for both sides — with reference to the FIR, medical report and statements under Sections 161 and 164 CrPC, the contents of the charge-sheet, the fact finding committee report. After this, it came to a conclusion that there was a clear prima facie case as alleged against the accused. However, it also said that the both the accused and the girl are talented students. They are pursuing technical courses at the institute. According to it, the investigation in the case was completed and it was unnecessary to keep the accused in custody.
"They are young in the age group of 19 to 21 years only and they hailed from two different states, continuation of detention of the accused in the interest of trial of the case, if charges are framed, may not be necessary,” the court in its August 13 order said.
Appearing on behalf of the survivor, advocate Sumitra Sarma and additional public prosecutor D Das, strongly argued that it would be a mistake to grant bail to the accused since it was a serious offence.
