The petitioner, Mohit Subhash Chavan, who works as a technician with the Maharashtra State Electric Production Company, argued that he could lose his job and in response, the court asked the government employee if he would “marry her”. Will you marry her? SC asked the government servant who is charged with repeatedly raping a minor girl. "You should have thought before seducing and raping the young girl. You knew you are a government servant," the court responded

As per the court documents, Chavan used to follow the 16-year-old girl, who is also a distant relative of his, on her way to school. One day, when her family members were out of town, he went to the house and allegedly raped her.
He told the top court that when the girl decided to go to the police, his mother had asked her to marry him but she had reportedly refused it. Following this, an agreement was established and a document was signed promising marriage once the girl turned 18. However, when she did, the accused refused to marry her. Following this, a rape complaint was then filed.
The Chief Justice further told him, "We are not forcing you to marry. Let us know if you will. Otherwise you will say we are forcing you to marry her."
Later, Chavan told the SC that he wanted to marry her initially but now he is already married. "I am a government servant and if I am arrested I will be suspended automatically," he said. The Supreme Court then granted the accused protection from arrest for four weeks and allowed him permission to apply for regular bail.
