The CBI had earlier opposed an FIR filed against Sushant Singh Rajput's sisters based on Rhea Chakraborty's complaint. The Mumbai police on Monday informed the Bombay High Court that the complaint lodged by Chakraborty was a "disclosed commission of offence" and that they were "duty-bound" to file an FIR, PTI reported.
Rajput's sisters - Priyanka and Meetu Singh - were booked by the Bandra police in September. The CBI labelled it as "vitiated and bad in law." As per reports, the Mumbai Police, however, denied the allegations and told the court that according to the affidavit filed in the court, it was not trying to damage the reputation of the 34-year-old deceased actor or his sisters. Rajput was found dead at his Bandra home on June 14. The police submitted the affidavit in the court, seeking dismissal of the petition filed by his sisters to quash the case against them.
What was the FIR about?
The FIR (against Priyanka and Meetu) was registered "based on the information provided by the first informant (Rhea Chakraborty), disclosing commission of offence," the affidavit read. It also stressed that Chakraborty had said in her complaint that a "bogus and unlawful" medical prescription "was sent by the petitioners with the help of a Delhi-based doctor wherein medicines for anxiety were prescribed to Rajput".
Rajput's family, including his sisters, have accused Chakraborty, of mentally harassing him. "This may have led to administration of psychotropic substances without actual examination of Rajput by the doctor, and may have caused and contributed in his suicidal death. This version of the informant disclosed cognisable offences warranting investigation and requiring no preliminary enquiry. Therefore, the Mumbai police were duty-bound to register the FIR," the court was told.
Last week, Chakraborty had appealed to the Bombay High Court not to dismiss the case against his two sisters. In her complaint, she mentioned about a couple of WhatsApp texts between the actor and his sister on June 8, indicating that it was Priyanka who had advised her brother to take three medicines were prescribed for depression and anxiety. It was earlier reported that his family was aware of his mental health problems.
“FIR lodged at Mumbai seeks investigation into alleged offence of conspiracy, forgery, cheating and conspiracy by petitioners sisters of Sushant Singh Rajput, Dr Tarun Kumar and others for fabricating medical prescription to procure and administer controlled drugs/psychotropic substances to Sushant Singh Rajput without his actual examination. FIR also seeks investigations into the possibility of deterioration of his mental health and eventual suicide pursuant to the said conspiracy,” the affidavit said, according to Live Law.
