Delhi Police To File Additional Chargesheet By October 15 In Delhi Cantt Rape And Murder Case

Delhi Crematorium Gangrape case: In the alleged gangrape and murder case of a 9-year-old Dalit girl at a crematorium in the Delhi Cantonment area, the Delhi Police are likely to file an additional chargesheet.

On September 29, the Delhi Police informed a sessions court that they will file a supplementary charge sheet by October 15. According to media reports, the investigative officer informed the Additional Sessions Judge, Ashutosh Kumar that they were waiting for the Forensic Science Laboratory results, following which the chargesheet would be filed.

The court then instructed the director of forensic science laboratory Rohini FSL to expedite the process and scheduled the next hearing in the case for October 21.  Adding to this, the judge asked the Investigating Officer on the status of the application seeking CCTV footage of the day of the incident. Adding that a notice will be issued to the IO as to whether the footage from August 1 and August 2 can be preserved or not.

On the other hand, the jail authorities informed the court that the accused (the same case) were safe and secured in the prison. These submissions were made in reply to an application alleging that the accused face threat to their lives and were allegedly beaten in a police van, while they were being brought to court.

To which, the judge said that it is not possible to provide a separate van for the accused of the case. Directions have been given by the jail superintendents to officials to ensure the safety of all the accused in the case during court and in jail.

The counsel of one accused named Laxmi Narayan alleged that the case of murder was not made against his client, also pointing out that there had been a delay of 10-hours in registration of the FIR. In answer to the query, the judge asked him to wait as the FSL reports are yet to come. The judge also pointed out at the extra-judicial confessions, which were admissible, despite being a "weak" piece of evidence

On August 28, the Delhi Police has filed a chargesheet against four people--Cantt crematorium priest Radhe Shyam, and his associates Kuldeep Singh, Salim Ahmed and Laxmi Narayan on charges of rape, murder, wrongful confinement, destruction of evidence under the India Penal Code (IPC) sections, and Protection of Children from Sexual Offences (POCSO) Act, 2012 and the Scheduled Caste and Scheduled Tribes Prevention of Atrocities Act, 1989.

The nine-year-old Dalit girl had been allegedly raped by the accused and was cremated when she died due to suffocation during the assault. The accused men then reportedly coerced consent from the girl's mother to cremate her, alleging that her daughter's organs could get stolen due to postmortem. The men had insisted that the minor had died due to electrocution while trying to fetch water from the crematorium's water cooler.

The death and hurried cremation led to a widespread agitation in the area following which the four men were arrested and charged. News reports suggest that the priest also confessed to abusing the minor on other occasions too. Read more about it here.
