The Delhi High Court on Thursday issued a notice to the Delhi government to file its response on the petition filed by a couple who could not register their marriage 40 years ago. The couple was underage back then and the software system did not accept their application.
According to reports, Justice Rekha Palli asked the government and other administrative officers to file a reply to the plea and scheduled the next hearing of the case for December 23. Advocate J S Mann moved the plea for the couple in the court and asked to register their marriage.
Couple Registers Marriage After 40 Years:
The petitioners reportedly told the court that they had approached the state for registering their marriage with the relevant documents but it could be done because the software system did not accept their application. The husband was below the age of 21 years and the wife was below 18 years of age at the time of their marriage on May 28, 1981.
Referring the fifth schedule to the Special Marriage Act of 1954, the petitioners urged the court to issue direction to the state government for the registration of their marriage. They also asked the court t direct for the waiver of the requirement to issue notice 30 days prior to the registration of marriage.
The couple said their petition that they have fulfilled all the conditions for the registration of the marriage as per the Sectio 15 of the Special Marriage act, 1954 and they have completed the age of 21 years at the time of registration and that the marriage was held on May 28, 1981, as per Hindu Vedic rites and ceremonies.
The plea added,"Since the date of marriage, the petitioners are running their family life as wife and husband respectively and out of the said wedlock, they have four children."
