The female law student who levelled rape allegations against former Union Minister Swami Chinmayanand disowned her statement before a special court in Lucknow. Following the development, the prosecution put forth an appeal to file a case under Section 340 of CrPc (false claim and false prosecution in a case) against the student after she turned hostile. The court asked the complainant to reply to the prosecution's appeal by the next hearing, which will be held today, October 14.

Chinmayanand case complainant turns hostile
As per ANI, on November 7, 2019, the Allahabad High Court ruled that former BJP MP Chinmayanand was entitled to get a certified copy of the complainant’s statement. In response, the female law student filed a plea challenging this order in the Supreme Court (SC).
Last week, on Thursday, the SC overruled the Allahabad High Court’s order which allowed Chinmayanand to access a copy of the alleged survivor’s statement, reported NDTV. Justice UU Lalit, who headed the SC bench dealing with the case, deemed that Chinmayanand shouldn’t get access to the law student’s statement to the magistrate as per section 164 of the Code of Criminal Procedure (CrPC).

What is the case about
In 2019, a female law student from Shahjahanpur, Uttar Pradesh, accused the former Union Minister of raping and physically exploiting her. She was a student in a Shahjahanpur- based college run by Chinmayanand. Subsequently, the police arrested Chinmayanand. However, he went on to file a case of extortion against the girl and three of her male friends - Sanjay Singh, Sachin Sengar, and Vikram alias Durges for allegedly demanding rupees five crore from him. Thereafter, the police took the student into custody for a brief period till the Allahabad High Court granted her bail. Back then, the LLM student said that police authorities fabricated the extortion angle to weaken her case against Chinmayanand. The Special Investigation Team (SIT) probing the case had filed a chargesheet for both the rape and extortion case.
