Britney Spears' legal attorney, Samuel D. Ingham III, has filed a petition that requests the judge to oversee her court-ordered conservatorship and to remove her father, Jamie Spears, and replace him with Jodi Montgomery.
What is a conservatorship?
A conservatorship is a form of adult guardianship in the US, which allows the conservator to be in charge of the conservatee. The conservator is mostly a family member. Since 2008, Spears has been her legal conservator. For more than 12 years, he has been in charge of both her person and her estate.
How did Britney land into a conservatorship?
Britney Spears landed under the conservatorship of her father in January 2008 when she was taken to a hospital for a psychiatric evaluation for refusing to return her children to her ex-husband, Kevin Federline.
The singer seemed to be under the influence of a substance when the police arrived. She further lost custody of her children and was admitted to a rehabilitation and medical centre in Los Angeles.
Jamie Spears then soon filed a temporary conservatorship over Britney and was granted rights by the court along with attorney Andrew Wallet. Despite the protest from Britney, the court decided that she was not capable enough to handle herself as well as her wealth on her own.
The conservatorship between Spears and her father has been a long and withstanding issue for the singer as well as the fans. Jamie Spears reportedly doesn't have a positive influence on the singer’s life.
Due to this, fans who want Britney to be free have started the #FreeBritney movement in 2019 to free her from the conservatorship. Slowly, the movement has gained momentum worldwide. Many celebrities and fans have shown their support towards it especially after the release of the Framing Britney documentary this year.
Jodi Montgomery to be permanent conservator of Britney Spears
Jodi Montgomery is the care manager of Britney Spears and now the singer wants her to be the conservator of her person. She had been Britney’s temporary conservator back in 2019 when Jamie had a health issue.
The petition asks that Montgomery should be able to "restrict and limit visitors by any means," except from meeting with Ingham. It also asks that Montgomery should be able to "retain caretakers" and "security guards" for Spears.
According to the petition filed, Jodi Montgomery will be in charge of Britney’s person and her well-being. Jamie will still be the co-conservator of Britney’s estate alongside Bressman Trust Company. This means that he will still be in charge of some of her finances and her business.
The next hearing for the conservatorship in court is scheduled for April 27.
