Kangana Ranaut Defamation Case: Plea To Quash Case
In July, Ranaut challenged the entire proceeding initiated by the magistrate, including all orders and summons in her plea.
Ranaut's counsel argued that the magistrate, instead of passing orders mechanically, has to be master of investigation himself and record reasons. He added that no material evidence was brought on record by the complainant in the case and the material was brought by a third party who did not examine on oath.
Ranaut's counsel added that it was a “one-sided investigation” and the magistrate unnecessarily asked the police to conduct an inquiry for himself by delegating powers to them stating that it was in contravention of the law.
Akhtar's counsel Jay Bharadwaj, on the other hand, opposed the plea and brought forward the fact that Ranaut did not attend the court previously on being summoned for an impartial inquiry.
Following the mentioned arguments, the Court concluded the hearing and reserved the appeal for order. The next hearing is likely to be on September 9.
