A 41-year-old man from Areekode, Kerala, was charged with 104 years in prison for raping his minor daughter over several years. The man lived with his wife and two children. In addition to the POCSO charges, the man has been fined a sum of Rs 1 lakh. He was convicted after trial in the Manjeri Fast-track Special Court by Judge S Resmi. The man was sent to the Tavanur Central Prison after the court denied him bail
Details of the case
His daughter, born in 2006, was seeking treatment in an Areekode hospital when this crime was uncovered. She was referred to Kozhikode Medical College for further treatment, where she was found to be pregnant. The doctors advised that the pregnancy be aborted and oversaw the procedure.
It was further discovered that the man had been raping his 17-year-old daughter for 7 years, from the time she turned 10 years old to the present. The case was investigated by Areekode Police Circle Inspector M Abbasali, SI M Kabeer, and Assistant SI K Swayamprabha. The prosecution at the trial was led by Special Public Prosecutor A N Manoj who revealed 24 documents and presented 22 witnesses.
His sentence
He has been charged with several counts under the POCSO Act and the Indian Penal Code, namely, POCSO Act section 5(m): whoever commits penetrative sexual assault on a child below twelve years and POCSO Act section 5(n): being a relative of the child through blood, with sentences of 25 years each.
In addition to this, he was charged under POCSO Act sections 9(m) and 9(n), which are sexually assaulting a child below twelve years and being a blood relative of the child respectively, which results in a sentence of 6 years each. Further charges included those under section 9(l); whoever commits sexual assault on the child more than once or repeatedly and IPC section 376(3); whoever commits rape on a woman under sixteen years of age - sentence of 20 years each.
