Actor Rose McGowan's RICO Lawsuit Against Harvey Weinstein Dismissed

Federal judge in United States of America, Judge Otis D. Wright, dismissed the RICO lawsuit against Harvey Weinstein on December 7. It was filed by Rose McGowan against Harvey Weinstein and his attorneys in 2019. McGowan called their act as "diabolical effort to silence the sexual assault victims".

The American actress, and a famous woman's right campaigner, Rose McGowan filed a case against Weinstein and the two lawyers associated with him, Bloom and Boeis. The allegations of McGowan, includes racketeering, invasion of privacy and fraud. According to her, they appointed a spy agency to stop her from publishing her book which had claims against Weinstein, in a deceitful manner.

About Dismissal of RICO Lawsuit Against Weinstein:

RICO stands for Racketeer Influenced and Corrupt Organisation. It was passed in 1970 to allow for the prosecution of all individuals who are involved in corrupt organisation. Rose McGowan filed it against Harvey and his attorneys, claiming fraud and racketeering. McGowan's major allegation were already dismissed in 2o2o itself. However, the court allowed to take forward the two allegations on Weinstein concerning fraud claims.

Judge Otis D. Wright in November  held that alleged party did not continuously silenced McGowan and it was all one time project with a "end goal and an end date", so this did not fall under provision of RICO. On November 24, McGowan's attorney, Julie Porter withdrew herself from the case after she was fired by her client Rose McGowan over a meeting on Zoom. She clarified that attorney client relationship had ended between them and she was not authorised to represent her.

McGowan was asked by the judge to file her case by December 3, failing which, the lawsuit has now been dismissed by the court.

How Did The Case Against Harvey Weinstein  Progress?

McGowan and Ashley Judd, were among the first women who publically to speak with their sexual assault allegations against Harvey Weinstein. Their story was published by New York Times in 2017.  Following this, many reports of Weinstein's similar conduct also came to the forefront. Actors, models and other professionals who worked with Harvey Weinstein brought forward their cases of sexual assault and exploitation for work favours, directly or indirectly to the media agency, newspaper. On March 11, 2020, the court pronounced 23 years prison term to the Hollywood Mogul for rape and sexual assault.

The #MeToo Movement had gained momentum after many such strong personalities came to speak of the ordeals on their social media channels and media agency.
