A four-year-old boy has been booked for allegedly raping his classmate in the washroom of a private school in Delhi. The girl complained that the boy used his finger and a sharpened pencil. Her mother said that the assault caused wounds in her private parts.
Since the child was so young, the police consulted legal experts. However, since there was a clear offence, a case of rape under the Protection of Children from Sexual Offences (POCSO) Act was registered
The police aren’t sure how to proceed with the prosecution given the boy’s age.
“The Indian Penal Code (IPC) provides children below seven years of age certain protections against prosecutions. We are examining those provisions even as we are handling the matter with utmost sensitivity,” said Dependra Pathak, Delhi Police’s chief spokesperson.
The boy is being counselled by an NGO, said Pathak.
The parents have accused the school management of negligence and said that the principal and teacher didn’t help after learning about the incident. They also refused to reveal details about the boy. They said that the fact that the classroom and washroom were unattended was a violation of the rules.
"I spoke to the principal as she had not bothered to answer my call or respond to my mail. She, instead, passed on the number of the school councillor. I asked to meet, she first said she will do so on Monday. I told her tersely, if it had happened with her daughter, what would she have done? She then agreed to meet,” said the girl's mother.
The school's lawyer says that the girl had not told any of the school authorities about the incident.
The boy had been shifted to another section, but the girl's parents want him expelled.
The murder of a seven-year-old Ryan International student also happened because the school's washrooms were left unattended. Let's hope security is given top priority in schools.
