In the porn film racket case where the First Information Report (FIR) was filed against actor Sherlyn Chopra, actor Poonam Pandey was named as an accused as well. On January 18, she has been granted protection from arrest by the Supreme Court of India.
The bench of Justices Vineet Saran and BV Nagarathna issued the order. The notice was issued to the Government of Maharashtra. The order was on the appeal filed by Pandey against the Bombay High Court order, which rejected her anticipatory bail plea.

The court said, "Issue notice...In the meanwhile, no coercive action shall be taken against the petitioner." On November 25, last year, she had appealed to the Bombay High Court for bail but was denied it. Last year in December, the Supreme court had also granted protection to Raj Kundra, who had an FIR registered against him for allegedly distributing pornographic videos.

Kundra was booked under relevant sections of the Indian Penal Code, Indecent Representation of Women (Prevention) Act and Information Technology Act for alleged distribution and transmitting the content.
Pandey had shared that the company had threatened her and forced her to sign the contract. She alleged that her private phone number was shared on the Hotshots platform. However, actor and model Gehana Vasisth, who was also arrested by Mumbai Crime Branch, had said that Pandey was taking advantage of the situation.
Poonam Pandey was earlier arrested by the Goa police for shooting an "obscene video" at the Chakoli dam site in Canacona. Back in 2011, she had claimed that if India won the world cup, she would strip naked. The BCCI did not grant permission for it.
In the same year, she morphed a nude picture of hers along with Sachin Tendulkar's, whose head was morphed on Vishnu's body. She was charged under section 295A of the Indian Penal Code (IPC).
In 2012, she again claimed to strip if Kolkata Knight Riders won the IPL that year and it trended worldwide on Twitter. In 2013, her film Nasha posters were burnt by political organisations, who called it "vulgar" and "obscene."
