The Bombay High Court today dismissed the plea of Rabia Khan, mother of late actor Jiah Khan. Rabia had petitioned that Jiah’s death be probed by a Special Investigative Team (SIT).
A Bench, comprising justices Ranjit More and Shalini Phansalkar-Joshi, said the Central Bureau of Investigation (CBI) is investigating the case and that there is no need to meddle with it. An elaborate version of the order passed by the Bench is expected to be made public by evening, reported Hindustan Times.
The judgment passed by the HC now laid the intervention application submitted by actor Sooraj Pancholi and Jiah’s then boyfriend useless. The application requested that Sooraj be given a chance to speak in the trial court as it is still in the process of framing charges.
Just last week, Rabia’s counsel had filed evidence claiming that Jiah’s case was that of homicide. The evidence included photographs of Jiah’s corpse, post-mortem report and another report having remarks from expert medical professionals of the UK, indicating that the nature of injuries on Jiah’s body can be due to homicide.
The counsel also stated that the CBI has neglected significant facts like the location of Pancholi’s mobile phone and the injuries on Jiah’s neck that couldn’t have resulted from hanging.
Rabia told the court that “her family had been suffering for more than three years.” In her view, the CBI has destroyed the case of her daughter.
The CBI, however, claimed that it had probed Jiah’s case meticulously. And they filed an affidavit which had forensic and medical reports that proved that Jiah had committed suicide.
The trial court had not taken any decision on the CBI charge sheet because of Rabia’s plea but after the HC order, it can go ahead and pass judgment taking cognizance of the chargesheet.
